MINUTES
EASTHAM BOARD OF HEALTH MEETING
THURSDAY, JULY 26, 2012 AT 3PM

Present:  Pat LaRiviere, Vice Chair, Beverly Knox, Dr. Martin Haspel, Susan Barker, Jane Crowley
Not Present: Dr. James Taylor, Chair



I.      PUBLIC NOTIFICATION RE VIDEO AND/OR AUDIO TAPE
Pat LaRiviere provided the notification.


II.     OPENING STATEMENTS
Jane Crowley provided the following updates:
·       A Summer Intern from Barnstable County is working with the Health Department, conducting inspections and working on projects.  Joanne is doing a wonderful job and Jane thanked her publicly.
·       Thumpertown and Campground Beaches were closed today due to bacteria.  They have both been retested and those results will be available Friday afternoon.  Signs have been posted to alert people at the beaches.
·       Molls pond is closed due to blue green algae and the Recreation Dept and the Police have helped us notify people about the situation.  The Code Red (reverse 911) call program went well and we received positive feedback.  Jane officially thanked the Sheriff’s department as they were a tremendous help in notification about a potential public health emergency.  The advisory is still in place for no swimming and to keep pets away from the pond.  We have also set up a link on the health page of the Town of Eastham website that allows people to check the updates from Barnstable County Health regarding water testing at our ponds.
·       Hazardous Waste Disposal day was held at the Eastham Transfer station on Saturday, July 21, 2012.  It went very well and 188 cars came in.
·       On July 10, 2012, the Medical Reserve Corp. hosted Sun Safety at Wiley Park and it went well.

III.    VARIANCE

1.      John & Jan Shea                         225 Higgins Road                M-7     P-451

Tim Brady, East Cape Engineering, presented.

The Septic System at this property will be upgraded.  For the upgrade, a variance to the setback from the SAS to the foundation is requested.  The lot is flat and the basement is just a basement.

Finding that the plan achieves maximum feasible compliance the BOH approved the plan dated June 19, 2012 as follows:

Beverly Knox made the motion to approve the variance request with the following conditions:
·       No increase in flow allowed
·       Deed restriction for 4 bedroom use to be recorded with Barnstable Registry of Deeds and a copy provided to the Eastham Health Department
·       Any increase in habitable space would require Eastham Board of Health review and abutter notification
Dr. Martin Haspel seconded the motion.

SO VOTED UNAMIMOUSLY


2.      Estate of Janice Brown                  25 Blue Hill Lane               M-17    P-519

Tim Brady, East Cape Engineering, presented.

The proposed septic system at this property requires variances to the setbacks from the SAS and a 25% reduction in the system area design requirement.

Finding that the plan achieves maximum feasible compliance, the BOH approved the plan dated 6/25/2012 as follows:

Dr. Martin Haspel made the motion to approve the variance request with the following conditions:
·       No increase in flow allowed
·       Deed restriction for 6 bedroom use to be recorded with Barnstable Registry of Deeds and a copy provided to the Eastham Health Department
·       Any increase in habitable space would require Eastham Board of Health review and abutter notification
Beverly Knox seconded the motion.

SO VOTED UNAMIMOUSLY


3.      Arthur & Agnes Haddad                   1950 State Highway              M-15    P-110

Eric Mitchell, J.C. Ellis Design, presented.

The proposed septic system at this property requires variances to the setbacks from the S.A.S. and no reserve area provided.

Finding that the plan achieves maximum feasible compliance, the BOH approved the plan revised July 5, 2012 as follows:

Beverly Knox made the motion to approve the variance request with the following conditions:
·       No increase in flow allowed
·       Deed restriction for 4 bedroom use to be recorded with Barnstable Registry of Deeds and a copy provided to the Eastham Health Department
·       Any increase in habitable space would require Eastham Board of Health review and abutter notification
Dr. Martin Haspel seconded the motion.

SO VOTED UNAMIMOUSLY


IV.     REVIEW

None

V.      REDUCTION IN TESTING

4.      James & Amanda Baughman         300 Samoset Road                M-14    P-135

The BOH noted their concern with the testing to date being done in 2 subsequent months rather in May and September as normally requested.   They also noted that the testing results for Total Nitrogen (Total Kjeldahl Nitrogen + Nitrate [NO3] + Nitrite [NO2]) exceed the maximum limit of 19 mg/l.  The owners are planning on moving to this property year round.  

The BOH recommends that the testing continue to be done 2 times a year but not in subsequent months.  May and September is the preferred split for the testing but as long as they are not 2 subsequent months.  After a 1 year period of operation and testing, reduction of testing could be requested to the BOH by the owner.  

Beverly Knox made the motion to deny the request for a reduction in testing at this time
Dr. Martin Haspel seconded the motion.

VII.    PERMIT APPROVAL WITH CONDITIONS – Eastham Transfer Station & Recycling Facility

Jane advised that Neil Andres, Superintendent of the Eastham DPW, is requesting a reduction in inspections.  Currently, the engineer is inspecting 4 times a year and reporting to the state based on the inspection.

Neil was not at the meeting to discuss so the BOH asked Jane to invite Neil to our next workshop or meeting.


VIII.   CORRESPONDENCE & OTHER INFORMATION

·       Stewart’s Seafood – In May, the BOH approved the variance request to eliminate external grease trap with plans that included an under the sink grease trap for the selling of gelato.  The state has denied the request and has requested additional information.  In addition the Plumbing Inspector has noted that some work should be done on the existing plumbing to the septic system and alterations have been required.
·       FinBars – The Health Department received a complaint about illegal disposal of food materials and waste water in the storm drain outside of their building which is actually an Eastham storm drain.  Orlean’s Health Department worked closely with the Eastham Health Department and DPW to resolve the concern and to have the storm drain pumped and cleaned.
·       Jane will contact Dr. James Taylor to review dates for the August Workshop and will communicate options with the committee by email.
IX.     ADJOURNMENT
